New Mexico has adopted the federal standard for asbestos exposure in general industry (brake and clutch repair, custodial work, and the manufacture of asbestos-containing products (11.5.2.9 NMAC)). The state has adopted the federal standards for protecting the safety and health of employees during asbestos abatement activities (alteration, repair, demolition, renovation, and removal) by reference (11.5.3.9 NMAC). The state's requirements for asbestos abatement certification follow federal certification guidelines.
State requirements must be at least as strict as federal requirements; otherwise, the federal rules apply.
The New Mexico Occupational Health and Safety Bureau (OHSB) administers and enforces workplace safety and health rules in the state.
