West Virginia Hazard Communication : What you need to know
Rules. West Virginia is not a “state plan” state; it does not have a federally approved occupational safety and health regulatory program. Private sector (private businesses and nonprofit organizations) employers are governed by the requirements of the federal Hazard Communication Standard.

Administration and enforcement. OSHA administers and enforces occupational safety and health, including hazard communication requirements, in the private sector in West Virginia. DOL inspects state government workplaces in response to fatalities and employee complaints.
