Alabama is not a “state plan” state; that is, it does not have a federally approved occupational safety and health regulatory program. Consequently, the federal Occupational Safety and Health Act governs safety data sheet (SDS) requirements in the private sector workplace. There is no state law that governs workplace safety in the public sector (state and local agencies, school systems). SDSs must be filed as directed by the federal Occupational Safety and Health Administration (OSHA).
