Comparison: State vs. Federal
Private sector employers (businesses and nonprofit organizations) in Illinois are governed by federal hazard communication, or worker “right-to-know,” requirements, including safety data sheet (SDS) requirements. Illinois has a federally approved occupational safety and health regulatory program for public sector (state and local government offices and operations) employers. The state has adopted the SDS requirements of the federal hazard communication rule by reference. For more information on the federal requirements, see the national SDS analysis.
The Occupational Safety and Health Administration administers and enforces workplace health and safety, including SDS requirements, in the private sector. The Illinois Department of Labor administers and enforces workplace SDS requirements for public sector employers.
