COMPARISON: STATE VS. FEDERAL
Indiana is a “state plan” state; that is, it has its own federally approved occupational safety and health regulatory program. The state has adopted the standards of the U.S. Occupational Safety and Health Act (OSH Act) entirely, including safety data sheet (SDS) requirements, so the state requirements are identical to the federal. The Indiana Department of Labor administers and enforces the Indiana OSH Act, including SDS requirements, in both the private and public sector workplaces.
