COMPARISON: STATE VS. FEDERAL
Virginia is a “state plan” state; that is, it has its own federally approved state job safety and health regulatory program. The Virginia Occupational Safety and Health Program (VOSH Program) governs safety data sheet (SDS) requirements in both the public and private sectors. The state has adopted the standards of the federal OSH Act entirely, including the Hazard Communication Standard and SDS requirements, so the state requirements are identical to the federal.

The Virginia Department of Labor and Industry (DOLI) administers and enforces the VOSH Program, including SDS requirements, in both the public and private sector workplaces.
