Ohio does not have a federally approved occupational safety and health regulatory program. Consequently, federal occupational safety and health standards govern private sector workplaces in the state.
The state has adopted by reference the federal safety and health standards for bloodborne pathogens in public sector (state and local government) workplaces (Ohio Administrative Code (OAC) 4167-3-01 and OAC 4167-3-04) in general industry and construction. The state has also adopted additional recordkeeping requirements for safe needles in public sector healthcare facilities that are stricter than federal rules.
The U.S. Department of Labor/Occupational Safety and Health Administration (OSHA) administers and enforces federal workplace safety and health requirements in private sector workplaces. The Ohio Bureau of Workers' Compensation/Division of Safety and Hygiene Services administers safety and health rules for public sector workplaces.
PUBLIC SECTOR-RECORDKEEPING FOR NEEDLESTICKS
In addition to records that may be required under the public employment risk reduction program, the employer of any public employee is required to maintain and submit accurate records of public healthcare worker exposure incidents of needlesticks or sharps to the public employment risk reduction program. These records must be submitted in a manner prescribed by the public employment risk reduction advisory commission. The records must contain:
- The date and time of the incident
- The type and brand of sharp involved
- The job classification of each worker involved
- The department or work area where the incident occurred
- The procedure the worker was performing at the time of the incident
