South Dakota does not have a federally approved occupational safety and health regulatory program for the state; therefore, private sector workplaces must comply with federal occupational safety and health standards.
There are no state or federal laws that govern workplace safety and health in public sector (state and local government operations) workplaces in the state, except a general requirement for the South Dakota Bureau of Personnel to develop programs for the improvement of state employee effectiveness, including training, safety, health, counseling and welfare (SC Statutes Annotated 3-6A-27).
The U.S. Department of Labor/Occupational Safety and Health Administration (OSHA) administers and enforces federal workplace safety and health requirements in private sector workplaces in the state.
