Comparison: State vs. Federal
Delaware is not a “state plan” state; that is, it does not have a federally approved occupational safety and health regulatory program. Therefore, the federal OSH Act governs occupational safety and health, including training requirements, in the private sector workplace. There are no workplace safety and health requirements for public (state and local government) sector employers.
